10/24/2006 Plan Commission Hearing minutes

Meeting called to order by Chairman Sweeney at 7:05 pm.

Minutes of October 10, 2006 meeting read. Motion by Remley to approve minutes as read.
2nd by Towns. Motion passed 4-0 (Vielhuber absent).
1st Order of Business: Conditional Use Permit application for Gary Nelson, 8049 W. Caledonia Road, Edgerton, WI 53534 to separate off the buildings on five (5) acres for farm consolidation in the SE ¼ of the SW ¼ of Section 14 per Zoning Ordinance Section 4.4(3)(A)(5) [4.5(3)(F) of 2006 Zoning Ordinance].

Discussion:
· Gary Nelson stated that the proposed lot has not been surveyed.
· The septic field is located out in the adjacent field.
· Remley asked if the trailer located on the lot is a rental. Gary replied that it is not a rental, that his stepson uses the trailer. The stepson does help out on the farm.
· Gary plans on raising steers and tobacco on the lot.
· Sweeney raised the issue of farm consolidation and the trailer being located on the lot.
· The trailer was used by Gary when he was the hired hand.
· A trailer has been there for at least 20 years. The trailer was replaced with a new trailer around 1990.
· Sweeney stated his opinion that a Conditional Use Permit should be looked for to see if the property has a CUP allowing the trailer. However, this is not an agenda item.
· Section 4.4(3)(A)(12) [4.5(3)(M) of 2006 Zoning Ordinance] is the section of the Zoning Ordinance pertaining to the trailer issue.
· No comments on CUP application from adjacent property owners.
· The trailer issue should be an agenda item.

Motion by Oakeson to approve the Conditional Use Permit application for Gary Nelson, 8049 W. Caledonia Road, Edgerton, WI 53534 to separate off the buildings on five (5) acres for farm consolidation in the SE ¼ of the SW ¼ of Section 14 per Zoning Ordinance Section 4.4(3)(A)(5) [4.5(3)(F) of 2006 Zoning Ordinance].
2nd by Towns. Passed 5-0.

Conditions attached to Conditional Use Permit:
· All lot setbacks apply.
· No new trees with mature height of 25 feet or more allowed within 25 feet of the lot line.

New Business:
· Cattle are to be put on the old Haakenson lot owned by Ron and Connie Arndt. (NE corner of intersection of County M and Riley Road.)
· Discussion on the lot and if there is already a Conditional Use Permit allowing more animals than would be allowed on 3 acres. There is a Conditional Use Permit already and it allows 100 large animals.
· Section 5.3(3) of 2006 Zoning Ordinance was read. Pertains to the revocation of Conditional Use Permits.

Next hearing is November 28th at 7:00.
