Town of Porter Board Meeting Minutes-April 17, 2006- 7:45 PM

Chairman Viney called the meeting to order. Present were Viney, Fox, Hamilton, Towns, Sanderson, Sweeney, Jeske and 5 residents.

Minutes: The March 20, 2006 minutes were read. Corrections: The building permit issued was for R. Crull, not B. Pernell. Burno is being sited by the DNR for removal of the dam. Hamilton moved, Fox seconded to approve the corrected minutes. Passed 3-0.
Receipts & Expenditures: The March 2006 receipts (8264-8267) and the April 2006 expenditures (checks # 7532-7558) were reviewed. Fox moved, Hamilton seconded to approve the receipts & expenditures. Passed 3-0.
Treasurers Report: Sanderson reported the account activity as of March 31, 2006. Checking Acct: $118,256.67; Outstanding Checks: $29,659.45; Local Government Investment Pool: $59,169.30. Hamilton moved, Fox seconded to approve the Treasurers Report. Passed 3-0.
Fire District Updates: Evansville: Chief is awaiting information from DOT regarding highway access onto State Rd. 213 for parcel on South edge of town. Feedback has been requested for other potential parcels for a new station. Edgerton: A new unit has been purchased for the back of the brush truck. Money is being raised for a training area.
Highways: Still awaiting the $10,000 credit from the County for their portion of the TRIP project. The winter maintenance check will be held until it’s received.
Recycling Center Report: Tire recycling day will be May 20, 2006. Ed Julseth & Ed Miller will work. the gates at the RC should be looked at.
Building Inspector/Zoning Administrator report: Jeske reported $300 in permits & applications for the month. Merri Pass/Chris Thorland-1600 sq.foot addition & 1600 sq. foot garage-$300. Jeske reported a non-compliant trailer on blocks on Casey Rd. Peter Burno is being sited by the DNR to remove the Stebbinsville Dam.
Town Hall: nothing to report.
Other: Fox moved, Hamilton seconded to pass Resolution #06-02 (attached). Passed 3-0. Fox moved, Hamilton seconded to pruchase the handicap Accessible voting maching according to State mandates. Passed 3-0. Hamilton moved, Fox seconded to grant a township permit to Bergendal Septic Service for use of town roads without restriction. Passed 3-0. Hamilton moved, Fox seconded to re-appoint Steve Oakeson to another 3-year Plan Commission term. Fox moved, Hamilton seconded to re-appoint Keith Axford to a 3-year Board of Adjustment term. Passed 3-0.
Hamilton moved, Fox seconded to adjourn. Passed 3-0. The next meeting will be May 15, 2006 at 7 P.M.

RESOLUTION NUMBER 06-02

RESOLUTION AUTHORIZING THE TOWN OF PORTER, IN THE COUNTY OF ROCK, THE ABILITY TO UTILIZE THE 6 MONTH ORDINANCE IMPLEMENTATION EXTENSION GRANTED BY ADMINISTRATIVE RULE ATCP 51.

Whereas, ATCP 51, the administrative rule relating to the siting of new livestock facilites (with an excess of 500 animal units) and the expansion of existing livestock faciliteis by more than 20% (and over 500 animal units), will be effective on May 1, 2006 for large business operations {and effective on July 1, 2006 for businesses with less than 25 employees or less than $5,000,000 annually in sales}; and

Whereas, ATCP 51 defines state standards that must be used by local governments that choose to regulate these new and expanding livestock facilities as defined by Sec. 93.90 (3) of Wis. Statutes through either a local licensing ordinance or a local zoning ordinance: and

Whereas, for the first six months after the the effective date of ATCP 51 from May 1, 2006 to November 1, 2006, a local government may deny local approval of an application based on the standards in ATCP 51 without incorporating those standards into local ordinance(s).

NOW, THEREFORE, BE IT RESOLVED that the members of the Town Board of the Town of Porter, in Rock County intend to regulate the siting and expansion of new livestock facilites over 500 animal units and those expanding facilites that expand more than 20% from the date of the effective date of the new law (and are over 500 animal units in size) as defined by statute and ATCP 51; and

NOW, THEREFORE BE IT FURTHER RESOLVED that the members of the Town Board of the Town of Porter in Rock County will utilize the 6 month ordinance implementation extension granted by ATCP 51 to incorporate the state standards into existing or new local ordinance.

Adopted the 17th day of April, 2006 by the Town Board of the Town of Porter.
