TOWN OF PORTER BOARD OF ADJUSTMENT HEARING MINUTES

FEBRUARY 16, 2006

 

Board of Adjustment members present: Chariman Diedrick and Smith. Also present: Viney, Fox, Hamilton, Towns, Sanderson, Sweeney, Jeske and 6 residents.

Chairman Diedrick called the Hearing to order.
Conformation of notification: published in the Evansville Review and Edgerton Reporter for the weeks of 2/1/2006 and 2/8/2006. Ten neighbors within 500 feet were notified by letters sent on 2/1/2006.
Agenda (1) Application for variance of Section 11.1 (b) to allow the alteration and change of use of a non-compliant structure to exceed 50 percent of the fair market value of the structure. The non-compliance of the structure is that the setback is less than code allows. The structure is a barn located at the intersection of Hwy 59 and State Hwy 138 at 11203 N. State 138, Evansville, WI. 53536 for Robert & Martha Degner.
Mr. Degner explained that he would like to add a shop to the interior of the barn, and in the future add a residence to the mow area.
After the building permit is granted, the exterior must be completed within 24 months.
It was moved by Smith, seconded by Diedrick to grant the variance to the above propery listed as (1). Passed 2-0. The decision is based on (1) Absence of Detriment-the variance will not create substantial detriment to adjacent property and will not materially impair or be contrary to the purpose and spirit of the Ordinance or the public interest. (2) Special Circumstance-the barn has always been there.
Smith moved, Diedrick seconded to adjourn the Hearing. Passed 2-0.
