Town of Porter Plan Commission Hearing minutes 3/25/2008

Members present: Alan Sweeney, Steve Oakeson, Stanley Vielhuber, Steve Towns, Basil Remley

Absent: None

Others: Russell Jeske, Jerry Fox and Phil Hamilton.  See additional sheet for other attendees.

Meeting called to order by Chairman Sweeney at 7:02 PM.

 

Minutes of April 4, 2008 meeting read.  Motion by Towns to approve minutes as read.

2nd by Vielhuber.  Motion passed 5-0.

 

1st Order of Business:  Review of Conditional Use Permits

Chairman Sweeney explained what we are doing.  We need to move ahead with reviewing Conditional Use Permits.  We are going to take today’s date as being a year to establish a starting point.  The basis of this discussion and review are from Sections 5.3(3) and 5.4(4) of the Town of Porter Zoning Ordinance.

 

1st Review: Rock Prairie Conditional Use Permit (Issued 10/25/05)

Mark Doudlah of Agrecol spoke about the relationship of Agrecol and DOT Manufacturing and that they want to consolidate to one location.  They want to sell current properties and move to the Town of Porter.  They are progressing and asked for a two or three year extension.

 

Discussion:

·         Viney – If they start within a year, they wouldn’t have to reapply for a Conditional Use Permit.

·         If they apply for a building permit within a year, that would be within the time limit of the CUP.

 

Motion by Vielhuber to extend the Conditional Use Permit for Rock Prairie for one year.

2nd by Remley.  Passed 5-0.

 

2nd Review: Scherber’s Conditional Use Permit  (Animal boarding CUP issued 9/28/04 and Non-ag storage CUP issued 9/27/05)

Steven and Susan Scherber have a CUP for vehicle storage and animal boarding.  All conditions are currently being met and the CUP is being used.  There have been no complaints.  No action is required.

 

3rd Review: Keehn Conditional Use Permit (Issued 5/25/05)

Ted Keehn was present.  Ted still has an Auto Dealers License.  All conditions are currently being met.  There have been no complaints.  Not action is required.

 

Discussion on how to proceed with reviewing Conditional Use Permits:

·         Options were discussed.

·         There may not be that many CUPs that need to be reviewed.

·         Review CUPs and contact the current owner of the property.

·         Sweeney and Oakeson will review CUPs and come up with a list.

·         We need to come up with a draft letter to the owner’s.

·         A group discussion was held to come up with a list of known CUPs that are not being used:

o       Lisa Otto at the corner of Hanson and Wilder

o       Jeff Conn property at the corner of County M and Tolles Road

o       Pass property on Wilder

o       The riding stable on Condon Road

o       Larson salt storage in Cooksville

o       Don Broten had CUP for cows

o       Haakenson has CUP for animals

o       Jeske has CUP for storage of non-agricultural items

o       There is a CUP on a property on Hwy 14 for boarding dogs and horses

 

Old Business:

The Allen property (which has been sold) has a CUP for the storage of non-agricultural items issued 8/5/2003.  No action is required.

 

New Business: None
