Town of Porter Plan Commission Hearing minutes-4/25/06

Members Present: Alan Sweeney, Steve Oakeson, Basil Remley, Stanley Vielhuber. Absent: Steve Towns. Others: Russell Jeske (Building Inspector); Dave Viney (Town Board Chairman); Phil Hamilton ( own Board Supervisor); See additional sheet for other attendees.

Meeting called to order by Chairman Sweeney at 7:08 pm.
Minutes of April 2, 2006 meeting read. Motion to approve minutes by Remley. 2nd by Oakeson. Motion passed 4-0.
1st Business: Cancellation of Conditional Use Permit Application by Kyah Norton & Deb Tuttle. Motion by Remley to untable the CUP request. 2nd by Stanley. Passed 4-0. Motion to cancel CUP request of Kyah Norton & Deb Tuttle by Oakeson. 2nd by Stanley. Passed 4-0.
2nd Business: Code violation of RV hookups & installation of RV on A-1 zoned property. Reference section 4.3(16) of zoning ordinance. Owner has not been contacted.
Jeske: Showed pictures of property. There are electrical violations with outlets not GFCI rated; no building permit for installation of generator & buried electrical conduit to numberous outlets set up for a number of camping sites.
Sweeney: Asked Jeske the following questions: (1) Building Permit issued? NO (2) Is there an issue with the RV being up on blocks? NO. The issue is with section 4.3(16) of the zoning ordinance & with electrial violations & no building permit issued.
Stanley: Stated that there is anotther “RV Park” at Wellnitz’s property. Discussion on similarities & differences between properties.
Motion by Remley to instruct Building Inspector Jeske to inform owners that they are in violation of zoning per section 4.3(16) & no building permit & what they need to do to correct violaions. 2nd by Oakeson. Passed 3-1. (opposed by Stanley)
3rd Business: Animal Siting Law
Discussion on Animal Siting Law and questions that need to be addressed. Note that some members of the Town of Center were present to discuss this issue. Some questions that were brought up are: (1) Is our current legal representation adequate? (2) Who will be responsible for reviewing the application? (3) How to align zoning with the State Statutes? (4) Is there a sample ordinance that the Town can use? (5) A registration system for existing facilities so that a base number of animal units can be determined for expansion purposes?
Glen Polich: Glen brought up that there are other things that the Town can use to maintain some control over growth. Some examples are: (1) How we treat right-of-ways. Regulate them? (2) Establishing a development fee. (3) High capacity well ordinance.
Viney: Discussed Town Board & Plan Commission members attending upcoming infomational meetings put on by Towns Association. (2) Discussed getting an attorney with animal siting knowledge in common with other surrounding Towns.
New Business: Jeske brought up legislation on ability of municipalities to regulate the reconstrucion of noncomfoming structures.
Motion to adjourn by Oakeson. 2nd by Remley. Passed 4-0. Meeting adjourned at 8:40 pm.
