Town of Porter Plan Commission Hearing Minutes-July 18,2006

Meeting called to order by Chairman Sweeney at 7:03 pm.

Minutes of June 27, 2006 meeting read. Motion to approve minutes by Towns. 2nd by Vielhuber.

Motion passed 5-0.

1st Order of Business: Zoning change application by Robert Degner of 11203 N. State Road 138, Evansville, WI 53536 to change the zoning for 7.9 acres from Agricultural One (A-1) and Rural Residential (RR) to Agricultural Three (A-3) with the remaining land to remain RR. The properties are located at 11203 N. State Road 138 in the NE and SE 1/4 of the SW 1/4 of Section 6.

Discussion: (Refer also to attached plan.)

- The property was purchased in 2000.

- There is a total of approximately 9 acres.

- There are currently 3 separate parcels.

- There will be driveway access to the back 7 acre lot. Given waver by Rock County to share the driveway between the two proposed lots.

- There is concern on the part of Rock County about putting septic on previous animal lot and near water.

- The septic is not shown in correct location on the plan provided.

- Why A-3 zoning? Allows for animals and buildings.

- Is Mill Street vacated? No.

- No clear ownership of Mill Street.

- Mill Street is landlocked.

- Setbacks are up to zoning at existing buildings, not including at the barn.

- Current house and barn are zoned RR.

Email from Carl Wolter (adjacent property owner) is attached. Carl states that he has no objections to the application.

Motion by Towns to recommend to the Town Board to change the 7.9 acres at 11203 N. State Road 138 in the NE and SE 1/4 of the SW 1/4 of Section 6 from A-1 to A-3 zoning.

2nd by Remley. Passed 5-0.

Findings of Fact: Creation of A-3 lot per section 4.6 of zoning ordinance.

Motion by Stanley to recess for Town Board Meeting.

2nd by Towns. Passed 5-0.

Recessed at 7:35 pm.

Motion by Stanley to bring hearing back from recess.

2nd by Towns. Passed 5-0.

Hearing resumed.


2nd Order of Business: Discussion and review of “Model Ordinance for Licensing Livestock Facilities”.

Discussion:

- Reviewed title of ordinance.

o Suggestion of “Ordinance for Conditional Use Permit for Livestock Facilities” - rejected

o Suggestion of “Livestock Facilities Ordinance” – accepted

- Section by section review of model ordinance:

o Section #1: Leave as is

o Section #2:

§ Change “licensing” to Conditional Use Permit”. Applies to entire document.

§ Keep the Purpose section only. Omit “Findings” section.

§ Put in “Town of Porter” where applicable.

§ Omit “Findings” in title of section.

o Section #3: Keep as is.

o Section #4:

§ Change heading to “Conditional Use Permit Required”.

§ Change 500 animal units to 400.

§ In subsection 3), change “…permit, license or other local approval” to “…permit or other local approval” by removing “license”.

o Section #5:

§ Discussion on whether or to keep or omit this section.

§ Recommend that the Zoning Administrator be the Livestock Facility Siting Administrator.

§ Keep as is.

o Section #6:

§ Make setbacks maximum as shown in document for all choices.

§ Omit subsection #3.

o Section #7:

§ 4 copies of application required.

§ Include the bold/italic paragraph in the ordinance.

o Section #8:

§ $1,000 application fee.

o Sections #9 through #15: Keep as is.

o Section #16:

§ Use range of $100 to $5,000 forfeiture.

o Sections #17 through #19: Keep as is.

Motion by Oakeson to recommend to the Town Board to adopt the amended Livestock Facilities Model Ordinance.

2nd by Remley. Passed 5-0.

Old Business:

- Sweeney checked with Rock County on the Animal Siting review fee of $750. The fee is a one-time fee and the application can be resubmitted for review without additional fees.

Next meeting not scheduled pending write-up of model Livestock Facilities ordinance by secretary Oakeson.
