TOWN OF PORTER PLAN COMMISSION HEARING MINUTES-12/20/2006
Members present: Alan Sweeney, Steve Oakeson, Basil Remley, Steve Towns, Chuc Gillespie
1st Business: Minutes of November 22, 2005 meeting read. Motion to approve minutes by Oakeson, 2nd by Remley. Approved 5-0.
1st Business: Zoning change from A1-RR for Iona Tofsland 5802 W. State Rd 59, Edgerton, WI in the NE 1/4 of NE 1/4 of Section 3. And amend the Zoning Map to reflect the Zoning Change.
Tofsland stated they plan to sell off a parcel of about 1.6 acres to Patrick & Kelly Deegan as a home site. The commission states that this parcel falls within the Smart Growth Rural Transition area. The proposed 1.6 acres would be taken from a 63-acre parcel. There were no objections from adjacent landowners and no comments from the public attending the hearing.
Motion by Gillespie to recommend to the Town Board to approve the
Zoning Change from A1-RR for Iona Tofsland, in the NE 1/4 of the NE 1/4 of Sec. 3, and to amend the Zoning Map to reflect the Zoning Change. This is based on the facts that the commission states that this parcel falls within the Smart Growth Rural Transition area. The proposed 1.6 acres would be taken from a 63-acre parcel. There were not objections from adjacent landowners and no comments from the public attending the hearing. 2nd by Remley. Approved 5-0. The Town Board Hearing will be on January 16.
2nd Business: Zoning change form A1-A3 for Garret Schumacher 8446 W. Adolphson Rd., Edgerton, WI. in the NE 1/4 of NW 1/4 and the NW 1/4 of NE 1/4 of Sec. 2. And amend the Zoning Map to reflect the Zoning Change.
The parents willed the farm and the children would like to divide the farm into two parcels. One would keep the existing house and buildings and the other would build a new home on the remaining acreage. Both children would like the option to raise animals, so they are asking for A3 instead of RR. The commission asks if there are any boundary disputes on the property. Schumacher said no. The commission states that this parcel falls within the Smart Growth Rural Transition area. The commission debated if A3 should fall in this Rural Transtion area. Other concerns included setting precedence that may affect other rural transtion areas in the Town and having fewer homes in the transition areas due to larger parcel zoning approvals. No comments from adjacent landowners
Motion by Oakeson to recommend to the Town Board to approve the Zoning Change from A1-A3 for two parcels in the NE 1/4 of NW 1/4 and the NW 1/4 of NE 1/4 of Sec. 2. for Garret Schumacher, and to amend the Zoning Map to reflect the Zoning Change. 2nd by Remley. Approved 5-0.
3rd Business: Review of Zoning Administrator Authority of building permits.
Bob Degnar of Cooksville would like to convert his barn into living space. This proposal has gained approval of the Cooksville Historic Committee but needs a building permit to begin work. After listening to both Mr. Degnar and Building Administrator, the commission decided both the Town and Mr. Degnar would be best served by having Degnar apply for a variance from the Town Board of Adjustment. They can review the case and possibly grant a variance for the Hwy. 2nd by Remley. Approved 5-0.
Other business: Chuc Gillespie has resigned from the Plan Commission due to personal reason. The Town Board at the January 16, 2006 Hearing will replace him. Chairman Sweeney motioned to appoint Steve Oakeson secretary beginning January 2006. 2nd by Remley. Approved 5-0.
Motion to adjourn by Remley, 2nd by Oakeson. Approved 5-0.
